Digital Media Terms of Use

Official College Channels are intended to keep individuals informed and engaged.

Whether participants and visitors are students, employees, parents, friends or fans, Flagler College welcomes everyone to share content and remain actively involved in digital media. By posting on or participating in any Official College Channel, students and employees agree to these Terms of Use as well as the following:

  • Flagler College’s Digital Media Policy No. 3.3.29
  • Flagler College’s Digital Media Procedures and Guidelines
  • the Family Educational Rights and Privacy Act (FERPA)
  • the Health Insurance Portability and Accountability Act (HIPAA) of 1996
  • National Collegiate Athletic Association (NCAA) rules and regulations
  • Flagler College’s Trademark and Branding policies and procedures
  • State and Federal confidentiality and privacy laws
  • All Flagler College policies including, but not limited to, the Student Handbook, the Faculty handbook, and the Staff Personnel Handbook.

Inappropriate Content

Flagler College maintains a commitment to having a vibrant, inclusive footprint on digital media and monitors for content and posts that deviate from these Procedures and Guidelines. While Flagler College understands and respects the concept of academic freedom and other rights guaranteed by Florida and Federal law, inappropriate content will not be tolerated. Flagler College reserves the right to delete or seek deletion of inappropriate content. The following are non-exhaustive examples of inappropriate content:

  • harassment or bullying
  • threats
  • obscenities
  • defamatory material
  • libel
  • illegal material
  • referencing alcohol or illegal substances
  • profanity
  • graphic violence
  • pornography
  • material that invades an individual’s privacy
  • infringements of patented, trademarked, or other propriety rights of others
  • impersonations of or pretending to be someone else
  • discriminatory content in violation of Florida and Federal laws
  • violations of Flagler College policies and procedures
  • violations of fair use, copyright, and disclosure laws
  • advertisements, spam, viruses, and commercial solicitations
  • any violations of State and Federal law not otherwise addressed herein (criminal, civil, etc.); violations of the Terms of Use and guidelines adopted by the third-party social media platform (Facebook, Twitter, Instagram, etc.)


When submitting content and/or posting on behalf of Flagler College or on Official College Channels, students and employees agree to the following additional Terms of Use:

  • Content-Students and employees are solely responsible for any content posted online.
  • Confidential Information- Students and employees will not post confidential or sensitive information, including, but not limited to, personal addresses, personal telephone numbers, personal email addresses, and personal contact information of other students, employees, alumni, or third parties.
  • Copyright- Students and employees attest that they are the copyright holder of all software, text, pictures, images, audio, video, and other information they post on Official College Channels or that they have received express written consent to post such material. In the event any information posted by students or employees infringes the copyright or proprietary rights of any individuals and/or entities, the student or employee who posted such material agrees to be solely responsible for any damage or harm resulting from their post.
  • Opinions- Student and employee posts do not reflect the views, opinions or policies of Flagler College.
  • Posts- Students and employees understand that their posts can be viewed by the public at large. Students’ and employees’ posts and material may be copied, edited and/or reproduced by third parties.
  • Statements by Others- Flagler College does not affirm the accuracy of facts or statements submitted by others on digital media.
  • Links- Links to other websites and blogs should not be misunderstood as an endorsement by Flagler College.
  • External Websites- Flagler College is in no way responsible for content on external websites.
  • Third-Party Platforms- Flagler College is not affiliated with any of the third-party digital media platforms that host Official College Channels (Facebook, Twitter, Instagram, etc.), with the exception of websites maintained on MyFlagler or Students and employees are expected to abide by the Terms of Use, privacy statements, and all other terms/guidelines adopted by third-party digital media platforms.
  • Data Collection- Students and employees understand that Flagler College cannot regulate any data or information collected by third-party digital media platforms, including third-party digital media platforms that host Official College Channels. Students and employees understand that Flagler College’s official websites collect data using Google Analytics (Google Privacy Policy).
  • Use of Content- By posting any content on Official College Channels, students and employees agree to expressly grant Flagler College the royalty-free, perpetual, irrevocable, non-exclusive right and license to use, reproduce, modify, adapt, publish, translate and distribute their posts and content (in whole or in part) worldwide and/or to incorporate it in other works. This may include, but is not limited to, reproduction in written materials such as advertisements, brochures, and informational materials and online in other digital mediums.
  • Hashtags- By using a “hashtag” in any post on digital media, students and employees consent to Flagler College sharing their hashtag and/or post on Official College Channels. A “hashtag” is a label or tag used in digital media to identify messages on a specific topic (ex: #FlaglerCollegeBaseball).
  • Compensation- Students and employees understand and agree that they are not entitled to any compensation or benefit related to their posts on Official College Channels unless such posts are part of the employees’ job responsibilities.
  • Illegal Content- Students and employees understand that if their posts contain illegal content, Flagler College may immediately provide the post(s) and content to the appropriate law enforcement agency.
  • Discipline- Students and employees understand that their posts may subject them to discipline up to and including expulsion (students) and termination from employment (employees) in accordance with Flagler College’s policies and procedures including, but not limited to, the Student Handbook, the Faculty Handbook, and the Staff Personnel Handbook.
  • Claims- By posting on an Official College Channel, students and employees agree to indemnify, hold harmless, release and forever discharge Flagler College, its current and former employees and officers, predecessors, successors, agents, insurers, directors, attorneys, and assigns, from any and all claims, counterclaims, disputes, demands, causes of action, damages, costs, attorneys’ fees, judgments or suits at law or equity of any kind whatsoever whether due or not, direct or contingent, liquidated or unliquidated, known or unknown, patent or latent, matured or unmatured, arising out of or as a result of their post to an Official College Channel.
  • Disorderly Conduct- Students and employees understand that if they engage in disorderly conduct online regardless of the particular digital medium while using Flagler College equipment or on Flagler College property or at Flagler College School-Sponsored events, they are subject to all applicable policies and handbooks of Flagler College. Students are reminded that the violation of any law, statute or ordinance, the violation of any Flagler College rules or other conduct that reflects discredit upon the institution is subject to review and appropriate disciplinary action regardless of whether it occurs off-campus, during vacations or between terms; and
    • “Disorderly conduct is any action or disruptive behavior, committed on or off campus that may result in a breach of the peace or a disturbance, or adversely affect the College community. Such conduct is a violation of College regulations and constitutes an interference with the standards and purpose of the College. Disorderly conduct includes, but is not limited to, the following: violation of any law, statute or ordinance; failure to comply with written or oral instructions given by the College staff and faculty in the performance of their official duties; the forging of a faculty/administrators’ name on any document and indecent or obscene conduct or expression. Any violation of this policy will subject the student to suspension or dismissal from the College.”
  • Governing Law – These Terms of Use shall be governed by the laws of the State of Florida. Venue for purposes of enforcing or interpreting these Terms of Use shall be in St. Johns County, Florida, or in the United States District Court for the Middle District of Florida.
  • Non-Agreement of Terms of Use- If students or employees do not agree to the Terms of Use, they should not post or provide content to Official College Channels.
