All Library Course Reserve materials will first be processed into the Voyager system to enable students to more easily identify and borrow through the Library. Both students and the Library staff supporting these studies will be able use Voyager to search Course Reserve materials by Instructor or Department. Copies of the reserve material will also be bar coded to facilitate borrowing and use within the Library.
As you can imagine this initial processing takes some time. So all we ask is that you provide us with your material 48 hours before the time you want students to have access to the material. Please drop these materials off at the Library's Circulation desk for processing.
Our Course Reserve procedures require that we maintain compliance with the Copyright Law of the United States (Title17, U.S. Code). We know that you will appreciate the importance of our efforts toward this end. It is imperative that the Library and the College function within the confines of Federal law.
Our greatest concern involves copied items (e.g., photocopies or video copies) and “course-packs” that are placed in Course Reserves, rather than bound or other published items. The optimal situation is that all copied items submitted for Course Reserve will include written permission from the copyright holder for the material’s specified use during the semester. We request that such permission be obtained and submitted with the material for Course Reserve. If permission has been granted, but it is not available in writing, or if you determine that the material falls under the “Fair Use” doctrine, the Library will accept a signed statement from you. You may find this at the bottom of the Fair Use work sheet. The Fair Use work sheet is designed to assist you in determining whether or not the copied item(s) you wish to place on reserve requires permission from a publisher. We recommend that you make several photocopies of this work sheet for future use. **NB: Every copied item for reserve must be submitted with a completed “Fair Use” worksheet.**
Please note that Copyright Law requires permission from the publisher before any item that has been placed on reserve here at the Proctor Library in the past, can be placed on reserve once again. ALSO, with respect to multiple photocopies, you may place a maximum number of three (3) copies of any one particular article, poem, video clip, etc., on reserve so long as it falls within the definition of “fair use.”
In the event that it becomes necessary for you to seek copyright clearance from a publisher, we recommend that you proceed in either one of two ways. First, we recommend that you email the publisher of the book, magazine, or journal explaining your need to place an item or chapter on reserve. Many Flagler faculty have received timely, and positive responses from publishers who sometimes will grant extended permission. Simply submit the positive response note with the item(s) to be placed on reserve at the circulation desk. Second, one can set up a free account at the Copyright Clearance Center: http://www.copyright.com. Through the CCC, you will be able to easily, and quickly obtain clearance in most cases. It is not unusual to be charged a small fee for permission, and you will receive an invoice in the mail. When such fees are charged to you, please drop off your invoice with the item to be placed on reserve, and the Library will cover this expense for you.
We ask that you be very careful about your interpretation of exceptions to the Copyright Law under the concept of “Fair Use for educational purposes” (teaching, scholarship and research) that are included in Section 107 of Title 17, U.S. Code. Interpretations can vary, but in general “Fair Use” should be limited and meet the rules for spontaneity, brevity and cumulative effect. Please see our fair use guidelines page that provides some guidelines for the use of these rules.
