Our policies and procedures support this. Under the federal law known as Title IX, discrimination on the basis of sex is strictly prohibited. Below is a list of resources that outline your rights, Flagler College’s policies and the steps to take should you need them.
Recognizing Sexual Misconduct
Sexual Misconduct is any unwelcome conduct of a sexual nature, including any conduct or act of a sexual nature perpetrated against an individual without consent. Sexual misconduct includes but is not limited to the following:
- Dating Violence
- Domestic Violence
- Sexual Assault
- Sexual Exploitation
- Sexual Harassment
- Sexual Intimidation
Consent is informed, freely and actively given, and mutually understandable words or actions that indicate a willingness to participate in mutually agreed- upon sexual activity. Consent cannot be validly given by:
- A person who is incapacitated
- Minors, even if the other participant did not know the minor’s age
- Mentally disabled persons, if their disability was reasonably knowable to a person who is not disabled
Incapacitated means lacking the physical and/or mental ability to make informed, rational judgments and may include being asleep or unconscious, having consumed alcohol or taken drugs, or experiencing blackouts or flashbacks.
